On 5 April 2024, the European Commission published Regulation (EU) 2024/1003 amending Regulation (EU) 2023/915 as regards maximum levels for the sum of 3-monochlorpropanediol (3-MCPD) and 3-MCPD fatty acid esters in infant formulae (IF), follow-on formulae (FoF) and food for special medical purposes intended for infants (iFSMP) and young children and young child formulae (YCF) in the Official Journal of the European Union.
The maximum levels for the sum of 3-MCPD and 3-MCPD fatty acids esters will be lowered from 125 to 80 µg/kg for food in powder form and from 15 to 12 µg/kg for food in liquid form. Background for the lowering of these maximum levels are recent occurence data from controls performed by the Member States available in the database of the European Food Safety Authority (EFSA) for the sampling years 2020-2022 indicating that – when compared with the maximum levels for these food categories set in 2020 by Regulation (EU) 2020/1322 – lower levels of 3-MCPD and 3-MCPD fatty acid esters in these food categories can be achieved following good practices.
Regulation (EU) 2024/1003 shall apply from 1 January 2025. Food listed in the Annex of Regulation (EU) 2024/1003 and lawfully placed on the market before 1 January 2025, may remain on the market until their date of minimum durability or use-by date.
